Informed Consent/Assumption of Risk:

I am aware that there are significant risks involved within all aspects of Cranberry Portage Winterfest events and activities. I understand that injury, death, or damage to property occurrences can not always be predicted with accuracy. I understand that the events offered by Cranberry Portage Winterfest can be extremely strenuous and push me to the limit of my physical abilities. I acknowledge that these events may result in serious injury or death to myself or others.

Waiver and Release:

I fully understand that participating in these events may have risks and I choose to participate voluntarily. I waive any claims, demands, causes of actions, or any claims for relief whosoever against, and release Cranberry Portage Winterfest (as well as any Cranberry Portage Child/Family Resource Center employees, board members, volunteers, or third-party vendors) from any and all liability, claims and/or causes of action that I may have for injuries or other damages arising out of the participation in Cranberry Portage Winterfest, including but not limited to events, and activities.

Indemnification:

I recognize that there is risk involved in the types of activities offered by Cranberry Portage Winterfest. Therefore, I accept financial responsibility for any injury that I may cause either to myself or any other participant due to negligence. Should the above-mentioned parties or anyone acting on their behalf be required to incur attorneys’ fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnity to hold harmless Cranberry Portage Winterfest, the Cranberry Portage Child/Family Resource employee, board members, volunteers, and third-party vendors from liability for injury or death of any persons and damage to property that may result from my negligent or intentional act or omission while participating in activates and events offered by Cranberry Portage Winterfest.

I have fully read and understand the forgoing of assumption of risk, the release of liability, and I understand that by signing it obligates me to indemnity the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act, or omission. I understand that by signing this form I am waving valuable legal rights.
